Section 122 Tariffs Remain in Effect Following Appeals Court Decision

U.S. courthouse with an American flag

The U.S. Court of Appeals for the Federal Circuit has ruled that the 10% Section 122 tariffs may continue to be collected while ongoing legal challenges move through the court system.

The decision temporarily supports the federal government's position, allowing Customs to continue assessing these duties as litigation proceeds. The court indicated that suspending tariff collection could create complications for the government, while any duties ultimately deemed unlawful could be refunded with interest, limiting potential harm to importers.

Currently, the 10% Section 122 tariffs remain in force and are scheduled to expire on July 24 unless further action is taken.
